Aníbal Lotocki's legal situation is becoming increasingly complicated. In recent hours, the Supreme Court of Justice rejected a key request from the doctor's defense, which sought to obtain the benefit of house arrest while awaiting the final sentence in one of the most delicate cases he faces: the death of Cristian Zárate.

According to Puro Show, Lotocki, who has been detained since October 2023, had filed an extraordinary appeal with the intention of serving his arrest at home. However, the highest court dismissed his request, arguing that the appeal was not directed against “a final or comparable sentence”, which automatically excluded it from consideration.

The judicial document was read on air by journalist Matías Vázquez, who highlighted that the appeal was rejected decisively. Lotocki's defense had tried to justify the request by appealing to personal and family matters, such as his role as a father, but the strategy was unsuccessful against the Court's criteria.

The case that harmed Lotocki after years of impunity

The case that keeps Lotocki behind bars corresponds to the death of Cristian Zárate, a patient who died after undergoing a clandestine cosmetic procedure performed by the doctor during the pandemic, when such surgeries were prohibited due to health restrictions.

As detailed by journalist Angie Balbiani, this case has a particularity that sets it apart from other high-profile cases in which the surgeon is also involved: it was a case of flagrante delicto. That is, the crime was committed, detected, and documented at the same moment, which reinforces the weight of the evidence against Lotocki.

This marks a substantial difference from other cases being processed against him, such as the deaths of Silvina Luna and Mariano Caprarola or the complaints from Pamela Sosa and Vicky Xipolitakis. In those cases, the consequences of the medical interventions manifested over time, making the judicial work more complex when it comes to proving responsibilities.

This new judicial setback worsens Aníbal Lotocki's current situation, as he not only remains detained for the Zárate case but also continues to accumulate investigations and complaints for malpractice and involuntary manslaughter.
