While the national government prepares its labor modernization project, the Córdoba metallurgical sector seeks to add technical proposals. The Chamber of Metallurgical and Component Manufacturers of Córdoba (Cimcc) presented a scheme of specific modifications with a high impact on productivity. The objective is to facilitate consensus between unions and employers without affecting acquired rights.
Economist Gastón Utrera, president of the Center for Metallurgical Production Studies, explained that this is a precise proposal. The reforms cover specific articles of the Labor Contract Law (LCT) and the Law of Trade Union Associations. According to the sector's analysis, the proposed changes could be implemented without the need for a complete restructuring of the labor system.
Las reformas abarcan artículos específicos de la Ley de Contrato de Trabajo (LCT) y de la Ley de Asociaciones Sindicales.
Proposals to reduce litigation and update regulations
One of the central points aims to reduce litigation arising from Article 212 of the LCT, used in disability claims. Cimcc proposes adding a paragraph that closes the possibility of disproportionate compensation before retirement. It also promotes adjustments to Law 24.557 on occupational risks to define disability percentages with greater precision.
The plan proposes replacing the current advisory council with a technical-scientific committee to determine disabilities using objective criteria. According to the document, this would reduce unnecessary lawsuits and legal costs for companies. The scheme aims to protect legal certainty without weakening coverage for actual accidents.
Another suggested reform seeks to correct distortions in the number of union delegates within small companies. Utrera indicated that the current excess increases labor structure costs and doesn't align with the needs of the modern market. The project proposes that Article 45 of Law 23.551 establish a maximum, not minimum, number of delegates per establishment.
El plan plantea reemplazar el actual consejo consultivo por un comité técnico-científico que determine incapacidades con criterios objetivos.
Salary incentives and efficiency in work management
Cimcc also proposes modifying Article 103 of the LCT to preserve productivity incentives. It seeks to prevent bonuses from becoming remunerative when repeated over time, avoiding their automatic increase in cost. This adjustment would allow for flexible schemes and improved efficiency without undermining wage rights.
Regarding leave, the proposal includes resolving the overlap between vacations and illnesses. It proposes that if a worker becomes ill during their vacation, medical leave would suspend the vacation and it would be reassigned later. This way, the employee is protected without disrupting the pace of production or generating new litigation.
The chamber's general approach prioritizes the stability of labor relations, reduction of conflicts, and legal predictability. The organization assures that the proposed changes do not entail a loss of rights, but rather regulatory clarity. The ultimate goal is to make hiring viable and stimulate productive investment within a modern regulatory framework.
