The judge in the case concluded that the act 'doesn't constitute a crime' and stated that there would have been consent

Just a few hours before the end of the judicial year, Tucumán's justice system ruled on the dismissal of the four former Vélez players, Sebastián Sosa, Braian Cufré, Abiel Osorio, and José Florentín, who were accused of sexual abuse in March 2024 by a journalist from Tucumán.
The decision was made by Judge Augusto José Paz Almonacid, a member of the College of Criminal Judges of the Centro Judicial Capital, and it became known after months of investigation and three hearings in which statements, expert reports, and technical evidence were evaluated.
In his ruling, the magistrate stated that "the act doesn't constitute a crime" and based his decision on the fact that there allegedly was consent. He also rejected the complainant's request to declare null and void the expert examinations carried out on the cell phones of witnesses linked to her.

The prosecution, represented by attorneys Patricia Neme and Alejandro Char, indicated in advance that it will appeal the ruling, which could lead to the review of the case by a higher court.
After the decision became known, the complainant spoke with TN and expressed her frustration: "These are those days when you feel that the entire path you traveled was worth nothing. A lot of helplessness, a lot of anger". She also questioned the judge's actions: "He was very determined to pursue the dismissal. So, although today's decision hits hard and feels like a bucket of cold water, it also is something predictable in Tucumán's justice system that doesn't protect victims".
The woman also stated that she will continue with the process: "I'm going to go all the way (with all the consequences). No one is going to deny the blood that was found, the injuries that I had. My father went to the police with my bloodstained shorts in a shoebox so that they could be examined".
The case that investigates the four former Vélez players
Since March 2024, Tucumán's justice system has been investigating the four former Fortín players after the complaint filed by a 24-year-old woman for an alleged sexual abuse. The incident allegedly occurred during the visit of the Liniers club to Atlético Tucumán for the eighth round of the Copa de la Liga.
The young woman stated that she made contact through Instagram with Sosa, who invited her to the Hilton Garden Inn hotel, where the squad was staying. After the match, past midnight, she went to the place and went up to room 407 to meet the goalkeeper. There she discovered that Cufré, Osorio, and Florentín were also present.

The complainant stated that she shared alcoholic beverages and that, after having a few drinks, she began to feel unwell and very dizzy. In that state, she lay down on one of the beds and stated that she was sexually abused. Around 5:30 a.m., when she managed to recover, she requested an Uber and returned to her home.
After these events, the players were accused of different offenses. Cufré and Florentín (both currently at Central Córdoba) are being investigated for sexual abuse with carnal access aggravated by the participation of two or more people as co-perpetrators, with an expected sentence of between 8 and 20 years in prison.
Meanwhile, Sosa (currently at Juventud de Uruguay) is being targeted for sexual abuse with aggravated carnal access as a secondary participant, while Osorio (currently at Defensa y Justicia) is being investigated for simple sexual abuse.
