Although it was expected that she would obtain house arrest, the court rejected the socio-environmental report that her defense had submitted.
The media figure's lawyer, Alejandro Cipolla, confirmed that the key hearing to determine her release from prison has been postponed again. This delays any possibility of transfer in the coming days.

According to Cipolla, the judicial refusal was based on observations from the socio-environmental report, which did not meet certain requirements for the residence in San Justo where Morena planned to serve her sentence. "There must be some structural issue to solve, because it is a precarious house and a minor will live there," the attorney pointed out.
The lawyer added that he plans to request his client's prison transfer, since the distance from the Magdalena facility makes visits difficult. "I can't provide a defense from 400 kilometers (249 miles) away," he warned.

The journalist's daughter, Jorge Rial, was detained on September 29, 2023 after the court revoked her release for failing to comply with procedural measures imposed. The Judicial Branch's report indicated that she did not attend court for two weeks nor did she submit the certificate for her psychological and psychiatric treatment.
