A prosecutor demands annulment due to 'lack of defense and arbitrariness' in the ruling.

Almost two years after the controversial kiss from the former president of the RFEF, Luis Rubiales, to the Spanish player during the celebrations for winning the Women's World Cup, prosecutor Marta Durántez submitted a request to the Criminal Chamber to repeat his trial, arguing "defenselessness and arbitrariness" in the ruling.
Among other things, the judge also requested one year of imprisonment for the former official for sexual assault and an additional year and a half for coercion, adding to her complaint Rubén Rivera, former head of legal services, Albert Luque, team director, and Jorge Vilda, former coach of the women's team.

According to the media outlet LaSexta, the judge highlights an "inconsistency in the sentence", urging the court to issue a new ruling that takes into account all the evidence presented in the case, and adds that there was a violation of the right to an impartial judge: "The judge displayed behavior throughout the hearing that compromises, at the very least, the appearance of impartiality." Additionally, she adds: "The magistrate did not ensure that the trial was conducted under the best communicative conditions, with a sense of calm and balance that would have been necessary," demanding that if the trial is repeated for the accused, it be conducted by a magistrate who is not questioned for their impartiality.
It should be remembered that in February, Rubiales was convicted by Judge José Manuel Fernández Prieto for sexual assault, leaving him acquitted of the crime of coercion, as well as Rivera, Luque, and Vilda, who were also charged in the case. At that time, he had been sanctioned only with a fine of 10,800 euros, when the National Court Prosecutor's Office had requested a total sentence of 2 years and 6 months in prison.
