The Spanish Javier Borrego stated that the corrupt former president could compete in the PASO despite her permanent disqualification, as "they are not for a position, but to define an internal contest."

The Spanish lawyer Javier Borrego, recently joined the defense of the multiple convicted former president Cristina Fernández de Kirchner, has launched a provocation that defies any institutional logic by stating: "Cristina Kirchner could run in the PASO system elections".

According to the former judge of the European Court of Human Rights, this maneuver would be possible because the primaries "are not initially for a position", but serve as "preparatory" elections for the future general elections. With a defiant tone towards the popular will, Borrego also warned that "If she runs, electoral support may be difficult for the opposition".

In an attempt to clean the image of the head of Kirchnerism, the foreign lawyer even declared in an audiovisual record that "Here Cristina is not a thief, or at least I haven't seen it in the papers", cynically ignoring the evidence of the largest corruption scheme in recent history.

From the Casa Rosada, the response to the electoral delirium of the defense was a cutting irony: "Great candidate", hinted a source from the political table of Javier Milei, making it clear that the figure of the convicted is politically finished.

While the opposition gets lost in speculation, the government is moving firmly in the Congress to eliminate the PASO, considering them an "unnecessary expense" that decent Argentines should not continue to finance.

This new legal "trick" arises in the context of a presentation before the Human Rights Committee of the United Nations Organization (UN) in Geneva.

A team of activist jurists, which includes the lawyer of Lula da Silva, Rafael Valim, aims for an 18-member panel of independent experts to review a ruling that is already final in Argentina.

However, the reality is that the UN Committee only issues non-binding recommendations and has no authority to annul the conviction or interrupt the disqualification imposed on the former president.

The record of Cristina Kirchner is unavoidable: she was sentenced by the Federal Oral Court No. 2 (TOF 2) to 6 years in prison and perpetual disqualification from holding public office for the crime of fraudulent administration to the detriment of the State in the Vialidad Case.

This ruling, upheld by the Supreme Court on June 10, 2025, includes a historic seizure of $684.990 million pesos against her and her accomplices, such as the frontman Lázaro Báez. Despite the cries of "proscription" and the demands for the "democratic cost of the politicization of justice", the Government of Freedom remains focused on sanitizing the institutions and ensuring that the stolen money returns to the Argentine people.
