The scandal surrounding the suspension of the match between Gimnasia de Jujuy and Deportivo Madryn took a new turn after it was confirmed that the complaint filed by referee Lucas Comesaña was dismissed and archived by the prosecutor in charge.
After analyzing the case, Diego Funes, head of the Special Prosecutor's Unit for Crimes against Property and Personal Integrity, concluded that there was not enough evidence to support the accusation nor elements that would classify the situation as a crime. For that reason, he decided not to proceed with the case.
In his report, Funes detailed the sequence narrated by Comesaña: Leandro Mayer, former secretary of Gimnasia de Jujuy, entered the referees' locker room to inform the fourth official, Gustavo Benítez, that he had just been accused of "child discrimination". There, according to the referee, Mayer allegedly added: "You'd better officiate the second half properly or the four of you will be locked up for three days for what you're doing in there".
The prosecutor, however, determined that these statements do not constitute threats in criminal terms. In his decision, he also confirmed that Benítez was indeed accused by the mother of a ball boy, who claimed that the referee told her son: "Come on, get out, you shitty Bolivian".
