The court decision upheld the ruling that had already acquitted the doctor and rejected the appeal filed by Andrea Karina Vázquez, after her son admitted in 2025 that the complaint was false and that he had been manipulated.

In a case that generated a strong public impact and debate on the functioning of the judicial system, the Buenos Aires Supreme Court upheld the acquittal of obstetrician Pablo Ghisoni, who had been imprisoned following a complaint of sexual abuse made by his eldest son,Tomas. had manipulated him to carry it out.
The decision of the highest provincial court upheld the acquittal that had been handed down in 2023 during an oral trial and which had subsequently been appealed. The decision came after the Court decided to reject the claim for extraordinary intervention filed by Andrea Karina Vázquez, Ghisoni's former partner and individual affected in the case on behalf of her

According to the document accessed by the media, the judges pointed out that the appeal submitted did not meet the necessary requirements to move to a new judicial instance. Specifically, by a majority, they concluded that what was raised by the complaint consisted mainly of procedural questions and disagreements with the evaluation of the evidence carried out by the previous courts. According to the court, this approach was not sufficient to enable the intervention of the highest provincial instance. In addition, they noted that Vázquez failed to demonstrate that “the previous resolution deprived substantive rights or violated guarantees recognized by the Constitution”, as he had
alleged.
The judicial process against Pablo Ghisoni had originally ended with his acquittal before Criminal Court No. 3 of Lomas de Zamora, by majority, in relation to crimes of sexual abuse aggravated by bonding and cohabitation, in separate acts against his two children. According to the initial accusation, these events occurred between 2012 and 2016 and2010 and 2014

Later, that acquittal was reviewed by Chamber I of the Court of Criminal Cassation, which also upheld the ruling by refusing the extraordinary appeal.
At that time, the arguments were similar to those now held by the Buenos Aires Supreme Court: the challenge presented by the complaint failed to demonstrate serious errors in the process, but only disagreements with the interpretation and assessment of the evidence that had already been evaluated in two judicial instances.
Ghisoni's story
After years of legal proceedings, last year Pablo Ghisoni decided to publicly share his experience in an interview with Telenoche.
There he described the personal and family impact of the cause. “Those who have children know what it represents and the pain it represents for each parent to lose them in life. Because this is what happened to me. I lost two of my children for ten years and the truth is that having seen that video liquidated me, I was very moved to see that he (Tomás) was able to understand the mother's pathology and the things she has done,” he said. He then added: “For me this is the beginning of a path of recovery.”
The doctor recalled that it all began in 2012, after several judicial conflicts with his ex-wife Andrea Vázquez and after reporting that she prevented him from seeing his children. In this context, a court ordered that the boys should live under their care, a situation that continued for four years

According to him, during this period, there was a regime of visits for the mother that had to be carried out under supervision. During one of those visits, he said, Vázquez made one of his sons say that he was pulling his hair in front of the social worker. That complaint led to the boys returning to their mother. Despite the fact that the Justice later ordered the return of the children to the parental home, the measure never materialized

The judicial conflict escalated even more when, according to Ghisoni's account, following a new order from the Court of Appeals for the children to return to him, his ex-wife filed a much more serious accusation. “The day after the Court of Appeals orders this, it files a complaint of sexual abuse with carnal abuse against me and my oldest son, who didn't keep it. The family judge says 'no, if there is a criminal case, I cannot make the reinstatement'. This has been the case from 2016 to date, I have not had contact with them again, nor has my oldest son, Francisco, also accused of the same thing

Following that complaint, Ghisoni was detained in a mental health institution for two years until he obtained house arrest, and after three years he regained freedom to face the trial
that finally acquitted him.
During the interview, he also expressed his strong criticism of the process he went through: “Not only do they not listen to you, but here the test is reversed. Especially men are not innocent until proven guilty. We are guilty. I was arrested without trial; I spent two years and three months in prison, six months under house arrest without a conviction. My children lost their lives, their childhood, they filled their heads
.”
In that context, he explained that during the judicial process the main evidence presented was the statement of one of the boys in the Gesell Chamber. “The result of this expertise was that the child's speech was crossed by the adult. That was the only proof of prosecution there was, because in the forensic examination the mother did not bring him to the boy for more than two years. The mother is a doctor, she knows perfectly well that the delay in carrying out an examination is essential. So she didn't let the expertise be done for two years. He did a bit of expertise.”
This situation led to the prosecutor desisting from accusing him, which ultimately led to his acquittal in the trial. Although the verdict was appealed, the ruling ended up being consolidated with subsequent revisions and now with the final confirmation of the Buenos Aires Supreme

The confession of his son
One of the moments that changed the course of the case occurred when Tomás, the eldest son, posted a video on his social networks where he publicly acknowledged what had happened. “I was not a victim of my father, I was used,” said the young man, who also maintained that his mother had filed the complaint and had taught him a false story. In that same message, he added: “Over time, the story became an emotional truth, with no real support. As a result, my father was imprisoned for three years. He lost his job, his name, his health, his dignity. In all of this, I too lost confidence in myself, my family and my dad for more than a decade.”
Despite everything that happened, Pablo Ghisoni assured that he never felt hatred for his children and that he kept the door open to rebuilding the family bond. “Last year (2024) we had the hearing in Cassation. At that hearing I said that when my children look for me, I'll be there and that's what I'm going to do. You are a father all your life and you want the best for your children and this is a bit of the path that we are now going to start walking with Tomás,” he concluded.
