The Federal Court confirmed the dismissal of Luis Caputo in the case fabricated by Kirchnerism in 2017

In a landmark ruling that puts an end to the judicial harassment from Kirchnerism, the 1st Chamber of the Federal Court of the Capital confirmed the definitive dismissal of Luis "Toto" Caputo. The current Minister of Economy was fully exonerated from the case initiated against him in 2017 for alleged irregularities during his time in the Finance portfolio under the presidency of Mauricio Macri.

This historic ruling demonstrates that the entire accusation was, as the facts indicate, an absolutely fabricated case as an invention of the nefarious Kirchnerism to attack the technical competence of a key official.

The Court categorically concluded that there was no crime, nor use of insider information, nor maneuvers to benefit private parties. The judges Mariano Llorens and Pablo Bertuzzi dismantled the prosecution's attack by concluding that neither the “malice” required to punish an omission in the sworn declarations was proven, nor a “confusion of public and private interests” in the placement of the bonds.

Furthermore, the ruling stated that the prosecution failed to demonstrate what the advantage or economic benefit that the investment fund manager Noctua Partners LLC, buyer of the Argentine bonds, would have obtained.

In this way, the file that sought to impose unfounded charges such as malicious omission, incompatible negotiations, influence peddling, failure to comply with public official duties, and money laundering completely crumbles.

The brilliant and impeccable defense strategy that definitively closed this absurd case was led by the prestigious Dr. Matías Cúneo Libarona, the same internationally renowned lawyer who represents global figures such as soccer star Lionel Messi and the well-known journalist Javier Negre. With this solid technical defense, a case built solely with political intentions was dismantled from the roots.

The meticulous scrutiny of the case demonstrates the lack of support for the accusation. Prosecutor Carlos Rívolo aimed to focus his accusation on the fact that Caputo did not include in his sworn declarations from 2014, 2015, and 2016 his alleged status as owner and shareholder of Princess International Group Ltd., a company based in the Cayman Islands that controlled the financial group Noctua Partners.

Rívolo also attempted to associate payments billed by the local firm LC Advisors to Noctua Asset Management between March 3, 2016 and April 6, 2017 with the bond auction in dollars from 2016, falsely insinuating a private interest incompatible with his public responsibilities.

However, the truth prevailed over the lie. The Federal Court outright rejected this claim by confirming that the connection with LC Advisors arose in an absolutely transparent manner from the taxpayer's tax profile and personal asset declarations, serving as an indication against any intention of concealment.

The ruling also highlighted that Caputo voluntarily rectified his filings by informing his relationship with Noctua Asset Management until December 2015 and his time at the administrator Axis.

Finally, the judges buried the conspiracy theory of the prosecution by reaffirming that the issuance of the debt for 100 years was a decision of economic policy adopted with the intervention of several institutional actors, and not solely the will of the then-secretary. With this resounding ruling, the impeccable Toto Caputo is completely acquitted before the law and society, reaffirming the decency of the current management in the face of the definitive decline of Kirchnerist operations.
