The supreme judicial body of the United States will grant the president the right to remove three members of the Consumer Product Safety Commission

On Wednesday, the United States Supreme Court allowed President Donald Trump to temporarily remove three members of the Consumer Product Safety Commission (CPSC) who had been appointed by former President Biden.

This decision is part of a series of rulings in which the highest court, with a conservative majority, has supported the latest measures of the current administration.

The recent ruling follows the precedent set in the Wilcox case, in which Trump was allowed to temporarily remove two senior officials from independent labor agencies while legal challenges were being solved.

The three liberal justices of the Court, Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson, dissented. In an opinion written by Kagan, they criticized the use of the "emergency docket" (an expedited procedure with little deliberation) to "undermine" the independence of federal agencies.

Who are the Biden officials dismissed by Trump

The three removed members, Mary Boyle, Alexander Hoehn-Saric, and Richard Trumka Jr., were appointed by Democratic President Joe Biden and confirmed by the Senate and played an essential role in the administration's trade policy.

Trump dismissed them in May, but a federal court ordered their reinstatement, a decision that Trump's administration appealed to the Supreme Court. With this new decision, the three commissioners will be removed from their positions again while the litigation continues.

In recent years, the Court has favored a broad interpretation of presidential power to remove executive officials, arguing that such power emanates directly from the Constitution.
