Camacho will return to Santa Cruz: Judge ordered his transfer due to the Decretazo case

After more than a year of waiting, the court accepted the writ of habeas corpus filed by the defense of the Santa Cruz governor

Masista justice has finally ordered the transfer of Luis Fernando Camacho from Chonchocoro prison to Santa Cruz. The Santa Cruz governor must attend his oral trial for the Decretazo case in person.

The hearing is scheduled for this Friday, July 25 in the eastern capital. This decision comes  after fourteen failed transfer attempts. All were prevented by noncompliance from the Penitentiary Regime.

The ruling was the result of a writ of habeas corpus filed by Camacho's defense. The constitutional ruling ordering the transfer is mandatory.

Attorney Martín Camacho stated that there are no longer any administrative excuses. He said that any noncompliance now would constitute a criminal offense. Chonchocoro was formally notified on July 15.

The judicial process for the Decretazo case is based on Departmental Decree 373. Through that decree, Camacho delegated his functions in 2022 to a secretary and not to the vice governor.

This action was considered contrary to the Constitution and the Autonomy Statute. The Prosecutor's Office accused the governor of issuing illegal resolutions. The trial was supposed to begin at the start of this year.

However, the hearing was suspended fourteen times due to the lack of transfer. Penitentiary authorities cited lack of budget and fuel. They also mentioned blockades and security issues.

The defense replied that those were excuses without legal basis. A ruling was finally obtained that requires Camacho's presence in court.

Attorney Martín Camacho explained that the judicial ruling is clear. It doesn't allow for further appeals or remedies. The ruling stipulates that the transfer must be carried out immediately.

Additionally, the governor must remain in Palmasola during the trial. This is also established by the current judicial resolution.

Regime's refusals

The latest refusal occurred in June of this year. The director of the Penitentiary Regime in La Paz refused to arrange tickets. She cited logistical limitations without presenting valid reports.

In response to that situation, the defense activated the writ of habeas corpus. Now justice has ruled in their favor.

In addition to the Decretazo case, Camacho faces other proceedings. The most advanced is the Golpe de Estado I case. It is in the final stage, awaiting arguments and a verdict.

There is also an investigation into the purchase of a fire truck. An unfinished proceeding for the 36-day strike in 2022 is also ongoing.

The defense accuses the Government of obstructing the trial in the Decretazo case. They point to the Ministries of Government and Justice as responsible.

They also mention the Attorney General's Office for filing unnecessary appeals. They allege that attempts were made to impose virtual hearings without legal basis. The court had ordered that the sessions be held in person.

According to Camacho's legal team, there are no longer any excuses to justify a new delay. Notification to Chonchocoro was carried out in accordance with the law.

The transfer must be executed before Friday, July 25. If it is not carried out, they will file new legal actions. They assert that they will enforce the constitutional ruling.

The Santa Cruz Governor, Luis Fernando Camacho, is a key figure in the opposition to masismo. His detention caused a strong national and international debate, due to the way the socialist regime acted.

Some sectors consider his imprisonment as part of political persecution. Others see it as an act of justice for his role in 2019. Tension is rising as the hearing approaches.

Friday's trial could mark a turning point. Not only because of the content of the Decretazo case.

Also because of the public demand that judicial rulings be respected. If the transfer is carried out, a chain of noncompliance will be broken. A new phase in the criminal proceedings against Camacho will begin.

In the political arena, Camacho keeps influence from prison. He supported Samuel Doria Medina's presidential candidacy.

Camacho remains the leader of Creemos, despite internal divisions. His transfer also has electoral implications. It may reactivate regional opposition from Santa Cruz.
