Justice in Córdoba: The accusatory system ends the bureaucracy of the file

Starting next June 15, the Federal Justice in Córdoba will experience its most profound transformation with the implementation of the new accusatory system. This scheme definitely buries the “mixed” model where the judge accumulated functions of investigation and trial.

With the full force of the Federal Criminal Procedure Code, the burden of proof will fall exclusively on prosecutors, who will manage cases based on criteria of efficiency and transparency.

The regulatory change proposes an adversarial system divided into three clear stages: investigation, intermediate and trial. In this scenario, the magistrate assumes the role of judge of guarantees, limiting himself to controlling due process without being contaminated by the evidence of the parties. Orality will be the governing axis, eliminating the bureaucracy of the paper file and requiring real-time resolutions, which will drastically speed up procedural deadlines

The reform seeks to reverse the stagnation of causes that, under the previous system, used to prescribe after years of inactivity and high wage costs. Attorneys General Carlos Gonella and Alberto Lozada emphasized that the new paradigm makes it possible to rationalize the workflow through alternative solutions. In the last 2 years, the resolution of simple conflicts made it possible to recover nearly $1 billion, funds earmarked for public assets.

Strict deadlines: The end of “dormant” cases in the courts

The new code imposes severe time limits to avoid judicial paralysis. Prosecutors will have just 15 business days to make the initial assessment of a complaint after it is filed. The preliminary investigation cannot exceed one year in duration, and the total process must be completed in a maximum of 3 years. This rigor ensures that the justice service ceases to be an inefficient expense and provides an effective response

to crime.

For highly complex causes, such as drug trafficking, the system enables special techniques such as the disclosing agent and controlled delivery. By offloading minor cases to areas of conciliation, the Public Prosecutor's Office will be able to concentrate its resources on dismantling criminal organizations. It is estimated that in jurisdictions with an accusatory system, convictions for serious crimes are achieved in an average of just 5

to 6 months.

Digitization will make the system accessible to citizens, providing face-to-face complaints or by email. Institutionality is strengthened by separating the functions of accusation and decision, eliminating judicial preconceptions before debate. Córdoba thus aligns with the standards of modern justice, prioritizing conflict resolution and the protection of

national heritage.

This shift towards adversarial justice promises to reduce the operational cost of the Judiciary, optimizing every peso invested in staff salaries. The disappearance of “investigative fiction” will force prosecutors to sustain accusations with compelling evidence in recorded hearings.
