On a day like today, exactly five years ago, the news of Diego Armando Maradona's passing shocked the entire world. On November 25, 2020, "Pelusa" died of a cardiorespiratory arrest and, since then, his family has maintained a firm pursuit of justice for what they consider a serious medical and organizational failure during his home hospitalization.

On this new anniversary, the case investigating criminal responsibility is going through a stage as decisive as it is turbulent. The original proceedings, which began in March 2025 and included more than forty testimonies, ended up being completely annulled after an unprecedented institutional scandal was uncovered in the Buenos Aires justice system.

During that first oral trial, Dalma and Gianinna Maradona attended regularly and pointed directly at two of the main defendants: neurosurgeon Leopoldo Luque and psychiatrist Agustina Cosachov, who were responsible for Maradona's clinical monitoring in the days leading up to his death. Alongside them, five other professionals are facing charges of "simple homicide with eventual intent."

Nevertheless, the proceedings collapsed when it was proven that Judge Julieta Makintach had authorized the clandestine filming of scenes for the documentary "Justicia Divina," recorded inside judicial facilities without the approval of the court or any of the parties. The episode triggered an immediate reaction from the defense teams, who requested her removal, and the magistrate ended up resigning.

Her departure forced the declaration of the total annulment of the trial, as it was considered tainted from the outset. Meanwhile, Makintach faced an impeachment jury in La Plata, where on November 18 she was unanimously removed from office for misconduct, bias, and conduct incompatible with her role. She was also permanently disqualified from holding any position within the judiciary.

The scandal did not end there, as the former judge is now under criminal investigation by the San Isidro Prosecutor's Office on charges of bribery, embezzlement, and manipulation of evidence and witnesses. Attorneys Fernando Burlando and Fabián Améndola even requested her arrest before Judge of Guarantees Esteban Rossignoli, arguing a risk of obstructing the investigation.

With the intervention of the Oral Criminal Court No. 7 of San Isidro, the case got back on track and already has a date for the new oral trial: March 17, 2026. It will once again be a process that will attract media and public attention, given the magnitude of the case and the symbolic weight that Maradona's figure still carries today.

Five years after his passing, the pursuit of justice remains open. 2026 could finally mark a decisive step toward a resolution in one of the most complex and high-profile cases in recent Argentine judicial history.
