An article that benefited prepaid health providers was eliminated, and the surplus of workers' contributions is being returned to them
The Government of Javier Milei announced this Tuesday the elimination of Article 12 of Resolution 2400 from 2023 of the Superintendency of Health Services, a provision signed by Kirchnerism just ten days before the change of administration that granted an undue privilege to private health insurance companies.
The presidential spokesperson, Manuel Adorni, explained in a press conference that this regulation allowed companies in the sector to keep the surpluses from contributions and payments made by workers for almost two years. “Thanks to this article, for almost 2 years, they kept billions of pesos that belonged to 1,800,000 taxpayers,” Adorni stated.

The official also announced that, as a result of this measure, the automatic subsidies received by each member must be clearly itemized on invoices, ensuring transparency and greater control by users over the benefits to which they are entitled.
In line with the announcement, the Minister of Health, Mario Lugones, reinforced the message through the social network X, where he celebrated the decision: “We repealed a hidden article in a resolution, signed 10 days before the change of administration, that allowed private health insurance companies to keep the surplus from contributions and payments that always belonged to workers. If a worker contributed 120, and their plan was priced at 100, the difference was kept by the insurance company. That is simple and ridiculous.”

Lugones added that, with the repeal, each company invoice must clearly reflect the automatic subsidy applied as a discount on the monthly fee, which he described as “a right of the member, not a benefit for the companies.” He also emphasized that “for almost two years, 1,800,000 people saw billions of pesos withheld from them,” something he considered an appropriation that ends today.
Milei's Government measure is part of the objective to strengthen transparency, competition, and freedom of choice in the health system.
