Amid the political persecution of Jair Bolsonaro, the future of the former Brazilian president will be decided by a commission of five judges from the Supreme Federal Court (STF), and, as has become known, all of them were appointed by or answer to the socialist dictator Lula da Silva.
The trial against Bolsonaro is being conducted before the First Panel of the STF, composed of five magistrates, and not before the full bench of eleven justices of the Court. Due to this concerning measure, the former president's defense unsuccessfully attempted to have the case tried by the full bench, but the request was rejected.
The First Panel of the STF is the court responsible for prosecuting and ruling on the case. The names listed on the commission are: Alexandre de Moraes, Flávio Dino, Luiz Fux, Cármen Lúcia, and Cristiano Zanin, all appointed by Lula or who answer to him.

The court scheduled daily hearings until Friday with the intention of bringing closure to a case that keeps Brazil deeply polarized. Last week, the arguments were already presented: the Prosecutor's Office, headed by Attorney General Paulo Gonet, requested the conviction of all the defendants and identified Bolsonaro as the alleged "leader" of the conspiracy, while the defense argued lack of evidence and requested acquittal.

Bolsonaro faces five charges related to the constitutional order, which could result in a sentence of up to 40 years in prison. The prosecution claims that during the 2022 presidential transition he orchestrated alleged "plans" to assassinate Lula da Silva and other authorities.
He is also accused, without evidence, of playing a central role in coordinating the protests of January 8, 2023, when supporters approached the headquarters of the three branches of government in Brasília as a form of protest.
The ruling will be decided by a simple majority among judges Alexandre de Moraes, Flávio Dino, Luiz Fux, Cármen Lúcia Antunes, and Cristiano Zanin. After the instructor's vote, it will be the turn of Dino, Fux, and Antunes; finally, Zanin, former personal lawyer of Lula, will have the responsibility of proclaiming the final result.
