The national government obtained approval in Congress for the Fiscal Presumption of Innocence Law, one of the central pieces of its economic reform agenda. The regulation, which is part of the second stage of the Historical Reparation Plan for Argentinians' Savings presented at the end of May, aims to structurally modify the relationship between the State and taxpayers, leaving behind a model considered punitive in order to move toward a framework based on the presumption of good faith.

The initiative proposes a deep change in the logic of the Argentine tax system. Its central focus is to replace the presumption of taxpayer guilt with the principle of fiscal innocence, which means that the State will have to demonstrate the existence of irregularities before moving forward with sanctions or criminal prosecutions. This way, the relationship between the tax authorities and citizens is redefined, with greater predictability and clearer rules.

A new paradigm in the tax regime

The Fiscal Innocence Law establishes substantial changes in the general tax regime. One of the key points is the increase in the thresholds from which the State can initiate cases for tax evasion. With this change, the aim is to concentrate oversight resources on relevant cases and ease the tax judicial system, significantly reducing the number of open criminal cases.

Another central aspect is the reduction of the statute of limitations period for determining tax debts. Under the new regulations, the State will have a shorter period to review tax returns filed in a timely and proper manner, which provides greater legal certainty for companies and individuals.

In addition, the law reinforces the principle that tax disputes must be solved through regularization and payment of the corresponding obligations, prioritizing administrative mechanisms over criminal proceedings.

Shielding of the simplified income tax regime

The regulation also introduces a shield for the new Simplified Income Tax Regime. Those who join will be able to normalize their asset situation by paying taxes based on their declared billing, regardless of past asset variations. This framework aims to facilitate the incorporation of taxpayers into the formal system, especially self-employed taxpayers under the simplified regime and small taxpayers.

Among the highlighted benefits is the impossibility for future administrations to review or pursue previous asset situations of those who have joined the regime, which reinforces long-term predictability.

The objective: formalizing savings and boosting the economy

The strategic purpose of the Fiscal Innocence Law is to encourage the formalization of savings that currently remain outside the financial system, commonly known as "dollars under the mattress". From the official perspective, channeling those resources into the formal circuit will make it possible to boost investment, strengthen consumption, and expand access to credit.

With this law, the government seeks to lay the foundations for a less punitive tax system, more rational and aligned with the need to reactivate the economy, consolidating a framework of trust between the State and taxpayers.
