Doctor Aníbal Lotocki has once again sat before a court to face a new criminal accusation This time he is being tried for simple homicide with eventual intent of businessman Rodolfo Christian Zárate, 50, who died after an aesthetic procedure performed in April 2021
The trial is taking place in the Oral Criminal and Correctional Court No. 17 Alongside Lotocki, four other health professionals and the director of the Conde Medical Center, known as CEMECO, located in the Caballito neighborhood, will also be tried. A surgical instrument technician is also facing charges of aggravated concealment for having hidden the surgeon's phone to prevent its examination
According to the prosecution's indictment, on April 16, 2021, Lotocki performed liposculpture and dermolipectomy on the patient, despite knowing the serious risks involved in those procedures. The prosecutor stated that the doctor relied on the belief that death would not occur and consciously omitted all measures that could have prevented that outcome
The accusation details that Zárate had pre-existing illnesses, was a smoker, and had had Covid. Additionally, it is noted that the necessary check-ups were not carried out nor was the operation planned in stages, something that would have reduced the danger of treating neck, chest, shoulder, armpit, arm, buttock, and abdomen tissues in a single session
