The administration of President Donald Trump has once again requested the intervention of the United States Supreme Court in a case related to his attempt to end deportation protections for thousands of Venezuelan immigrants in the country.
These protections were granted under the Temporary Protected Status (TPS) program by former Democratic President Joe Biden during his disastrous term, specifically in 2021 and expanded in 2023, as a response to the humanitarian crisis in Venezuela.
The Department of Justice filed an emergency petition with the Supreme Court on Friday, arguing that a recent decision by a federal judge limits the authority of the current Secretary of Homeland Security, Kristi Noem, to terminate the program.

According to the request, while the lower court's order remains in effect, more than 300,000 Venezuelans with irregular immigration status will be able to remain in the United States, even though Noem determined that maintaining this protection, even temporarily, "goes against the national interest."
Previously, in May, the Supreme Court had already intervened in this same case, supporting the Trump administration by lifting a temporary order from Judge Edward Chen of San Francisco, who had blocked the termination of TPS while the litigation was ongoing.
However, on September 5, the same Judge Chen issued a shameful final ruling, concluding that Noem's decision to rescind TPS violated federal laws governing the operation of government agencies.

The elimination of TPS for Venezuelans is part of Trump's plan to tighten immigration policy for those immigrants who enter the country illegally.
The TPS program is a humanitarian designation that allows people from countries affected by wars, natural disasters, or other crises to remain legally in the United States, with protection from deportation and work authorization.
Biden's decision to grant TPS to Venezuelans was based on the ongoing political, economic, and social crisis in Venezuela, but it was partially reversed by Noem, who canceled the extension granted in 2023 to a specific group of Venezuelan beneficiaries.
The Department of Justice argued before the Supreme Court that the case reflects a troubling trend: lower courts disobeying Supreme Court orders in emergency cases.
