The administration of President Donald Trump intensified its offensive against states and local governments seeking to limit the enforcement of federal immigration laws. The Department of Justice (DOJ) filed a lawsuit against Virginia and warned that the state risks becoming ''the next California'' if it maintains a series of measures that interfere with the work of federal authorities.

The case was announced by the Deputy Attorney General for the Civil Division of the Department of Justice, Brett Shumate, who stated that the new rules approved by the state legislature represent a direct challenge to the constitutional authority of the federal government.

''We are suing Virginia to prevent it from becoming the next sanctuary jurisdiction, just like California,'' Shumate asserted. He explained that the lawsuit seeks to block two laws that would take effect on July 1 and that, according to the federal government, hinder the operations of immigration agents.

The first of the rules imposes restrictions on the use of masks or facial coverings by security agents and requires federal officials to display visible identification during their operations. The second limits voluntary cooperation agreements between local police agencies and the Immigration and Customs Enforcement (ICE), reducing collaboration in immigration control tasks.

For the Department of Justice, these measures violate the Supremacy Clause of the U.S. Constitution, which establishes that federal law prevails over any incompatible state legislation.

''States do not have the authority to regulate or dictate how the federal government performs its functions, especially when it comes to law enforcement,'' Shumate maintained. The official argued that Virginia is attempting to impose conditions on the activities of federal agents, something he considers unconstitutional.

The lawsuit targets the Attorney General of Virginia, Jay Jones, and the Fairfax County Attorney, Steve Descano, a figure linked to progressive movements and previously supported by organizations associated with billionaire George Soros.

From the Trump administration's perspective, there is a strong precedent to support its position. Earlier this year, the federal government filed a similar lawsuit against California and achieved a significant legal victory when a federal appeals court blocked a rule pushed by Democratic Governor Gavin Newsom that required federal immigration agents to identify themselves during operations.

The ruling was interpreted by the White House as confirmation that states cannot impose restrictions that interfere with the tasks of federal authorities. Therefore, the Department of Justice argues that the situation in Virginia is virtually identical and expects to achieve the same outcome in court.

The comparison with California is not coincidental. For years, the state governed by Newsom has been one of the main flashpoints of conflict with Washington on immigration issues. Critics argue that the policies pushed by Democrats have hindered cooperation between local and federal authorities, favoring the expansion of sanctuary jurisdictions and complicating the deportation of illegal immigrants with criminal records.

From the Trump administration's perspective, these initiatives reflect a broader trend within the Democratic Party to prioritize ideological considerations over public safety and law enforcement. Republican officials argue that the restrictions imposed on ICE limit the authorities' ability to detain criminals and execute deportation orders issued by federal courts.

The Department of Justice also expressed concern about the risks faced by immigration agents. Shumate stated that the new laws could expose federal officials to criminal proceedings, harassment campaigns, and even the disclosure of personal information.

ICE has defended the use of masks during certain operations, especially in a context of increasing hostility towards its agents. The agency argues that protests and disturbances recorded in various parts of the country have increased threats against officials and their families, making it necessary to adopt additional protective measures.

The Trump administration made it clear that Virginia will not be the only target of this strategy. According to Shumate, the Department of Justice is monitoring similar legislative projects in other states and will act quickly against any initiative it considers an interference with federal authority.

''Any state considering passing this type of law should know that we will file lawsuits and seek court orders to prevent their implementation,'' he warned.
