A new controversy shakes the political and judicial scene in Brazil following the release of a ruling in the Supreme Federal Court (STF) involving Judge Alexandre de Moraes and members of the former president's family Jair Bolsonaro. Moraes voted to sentence federal deputy Eduardo Bolsonaro to one year in prison for a message posted on social networks that
was considered defamation.The case originated from a publication in which Eduardo Bolsonaro accused the deputy Tabata Amaral of promoting a legislative project that benefited a donor to his campaign. The magistrate concluded that this statement constituted an accusation without sufficient evidence and that it affected the “honor” of the legislator, which, under Brazilian law, may
constitute a criminal offence.The decision has generated strong criticism across the country, especially because of the severity of the proposed penalty. In Brazil, defamation crimes are often subject to sanctions that include fines or civil reparations, so the use of custodial sentences in this context has been singled out by critics as a
totally disproportionate measure.
In parallel, Moraes ordered the opening of an investigation against Senator Flávio Bolsonaro, Eduardo's brother, also for a social media post that has been described as “defamatory” by Brazilian socialism. This process has attracted particular attention due to its possible political impact, since Flávio Bolsonaro appears to be one of the most relevant figures in the face of future electoral disputes and has been mentioned in polls against the current communist president Luiz Inácio Lula
