The Federal Justice of Jujuy annulled the intervention of the local Justicialist Party ordered by Cristina Fernández de Kirchner and rescinded the decisions taken by the controllers Aníbal Fernández and Gustavo Menéndez. Instead, he appointed Ricardo Guillermo Villada, a leader linked to the governor of Salta, Gustavo Sáenz, who will assume control of the party for a period of 180 days
.
The ruling, signed by Judge Esteban Eduardo Hansen, orders progress in the institutional normalization of the Jujuy PJ under judicial supervision. Villada must submit reports every 15 days detailing the progress of the process and establish an electoral schedule that allows for regular renewal of authorities
. The intervention of the convicted woman disrupted the party's internal democracy at the local level.
The resolution originated from a presentation promoted by different sectors of local Peronism, including Senator Carolina Moisés, who had been questioning the leadership of the party under the orbit of
Kirchnerism.
In his analysis, the magistrate was forceful in describing the irregularities detected during the intervention. He pointed out that since mid-2023, the Jujuy PJ had been intervened, but the promised internal elections were systematically postponed, suspended or altered by disciplinary decisions that deepened
the internal crisis.
One of the most critical points of the ruling was the suspension of more than 300 members, including pre-candidates, without their right to defense being guaranteed. According to the judge, these sanctions were applied without adequate procedures, without disclaimers or evidence, directly affecting democratic participation within the
party.
In addition, the court questioned the decision of the auditors to cancel the current electoral process and call for new elections without first restoring the rights of the suspended members. For Justice, this maneuver involved a substantial restriction of intra-party political rights and altered the conditions of competition
. Cristina Fernández de Kirchner is serving house arrest.
The ruling also details a succession of failed dates for holding internal elections, which were repeatedly postponed without concrete progress in their organization. This situation, according to the court, evidenced the absence of real will to restore the party's institutional normality
.
In this context, the magistrate concluded that judicial intervention is the only possible mechanism to overcome the internal crisis and ensure a transparent process. The objective, he remarked, is to ensure clean elections, with clear rules and full respect for the rights of members
