The Attestor Master and Bainbridge funds requested the US courts to end the litigation over the defaulted debt

The funds Attestor Master and Bainbridge, creditors who were involved in litigation against Argentina for defaulted bonds since 2001, requested before the U.S. Justice the definitive closure of the cases after confirming that they have already received the amounts agreed upon with the Government of Javier Milei.

The legal filings mark a key step in the processes opened in the Southern District Court of New York, where most of the lawsuits related to the defaulted debt are concentrated. In this court, currently presided over by Judge Loretta Preska, Bainbridge formally communicated that the ruling in its favor was fully satisfied.

The document submitted on July 29 details that the fund had obtained a final ruling on December 1, 2020, for its holdings of defaulted bonds. Subsequently, on April 1, 2026, Bainbridge and Argentina reached a settlement agreement that included the full payment of principal, interest, and other related claims. “The ruling in favor of Bainbridge was fully satisfied with the payment,” stated the document presented to the court.

In parallel, Attestor Master also confirmed having received the agreed amount and moved in the same direction by requesting the termination of the judicial processes in which it was involved. Both funds were part of the group of holdouts that had not participated in the debt exchanges following the default.

The request for closure of the cases came after the Argentine Congress ratified the agreements reached with the creditors, a necessary requirement to enable the payments.

The corresponding law was approved at the end of June and published on July 1 in the Official Gazette, encompassing two differentiated agreements: one with Bainbridge and another with a group of funds led by Attestor Master.

According to official reports, Bainbridge received USD 67 million as total cancellation of its claim. In the case of Attestor Master, the amount was around USD 104 million, although the complete details of the agreement were not publicly disclosed.

As a result of these filings, both funds will cease to be listed as active litigants against Argentina in the cases related to the defaulted debt. Thus, the cases are moving towards their definitive closure in the U.S. jurisdiction.

The Treasury had previously indicated that the payments would be recorded as “debt services,” although the timing of the disbursements remained to be defined. The confirmation made by the creditors themselves before the Justice indicates that this stage has already been fulfilled.

With the progress of these closure requests, the cases initiated after the 2001 default continue their process of completion in international courts.
