
Controversy in Córdoba: Judicial abuse reported after a street fight in the downtown area
An employee was arrested after defending himself in a road rage incident. The aggressor remains free, and everything was recorded on video
An incident that took place in downtown Córdoba has once again brought into question the role of the justice system in the face of urban insecurity. A worker who was trying to preserve a parking space was assaulted by a motorist. Although he was struck first, he is the one who has been in jail for more than a week.
The video clearly shows how the conflict began over a spot reserved for a transport bus. The driver of a white Tracker got out of the vehicle and physically assaulted him. The worker tried to defend himself, but the justice system decided to detain him.
The incident occurred on Balcarce Street, between Entre Ríos and San Jerónimo, right in the central area of the city. The victim works at a local parcel warehouse. Since the moment of his arrest, he has been held at the Detainee Containment Unit (UCA).

What about self-defense?
Defense attorneys Diego Rodi Bustos and José Manuel Roque assert that their client acted in self-defense. "He was assaulted by a person of larger build and acted to protect himself," they stated. They also emphasized that the aggressor is free and that the video is compelling.
The case once again raises the issue of arbitrary use of judicial power against those who lack connections or resources. The detained worker is the breadwinner for his family and has no criminal record. However, he has been in jail for 10 days while the aggressor still faces no formal charges.
According to the defense, the driver involved is reportedly a concierge at a nearby hotel. The vehicle belongs to the owner of the establishment. For the attorneys,there is differential treatment due to personal connections or economic interests.

The right to defend oneself can't be a crime
In a republic, defending oneself from an assault can't become grounds for imprisonment. If the evidence shows who initiated the attack, there are no excuses. The justice system can't look the other way when the victim ends up treated as a criminal.
The state's legitimate monopoly on force should not be applied against ordinary citizens who act prudently in the face of aggression. The worker was pushed, struck, and reacted. It is not fair for the person who suffered the violence to end up deprived of his freedom.
The attorneys have already filed a criminal complaint against the Tracker's driver. They expect the prosecutor's office to act ex officio and consider the video as the main piece of evidence. The defense expects the worker to regain his freedom in the coming hours.

The law must be equal for everyone, not just for some
Judicial abuse not only harms individual rights: it also sends the wrong message to society as a whole. How can anyone trust a system that imprisons those who defend themselves and releases those who attack?
In this case, what is at stake is more than one man's freedom. This is about the basic principle of equality before the law. If it is not corrected in time, the damage will be much greater than a single injustice.
