The lawyer for the corrupt former president Cristina Fernández de Kirchner, Carlos Beraldi, submitted to Judge Jorge Gorini, who is responsible for enforcing the sentence in the Vialidad case, a request for house arrest for the convicted individual, who must serve six years (6 años) in prison following the confirmation of the conviction for fraudulent administration to the detriment of the State.
In the document, Beraldi proposed as the place of compliance the residence located at San José 1111 Street, in the City of Buenos Aires. He also requested that she not be required to wear an electronic ankle monitor and that the official security detail currently protecting her be maintained.
Among the arguments put forward to request the mitigation of the sentence, the defense attorney stated that Cristina Kirchner, as a former head of state, possesses "state secrets" and recalled that she was the victim of an assassination attempt on September 1, 2022.

The filing was made after the judicial notification ordering the nine convicted individuals in the case to appear on Thursday, June 19, at the Comodoro Py courts, in order to enforce the final sentence for fraudulent administration.
In this situation, prosecutors Diego Luciani and Sergio Mola requested the immediate detention of Cristina Kirchner and the other individuals involved.
"The absence of an immediate punitive response—that is, not enforcing a sanction that also serves as a signal of disapproval of the actions of those who have been convicted—could create the perception that the rules of domestic law and the international system intended to prevent, investigate, and punish acts of corruption are not applied as a standard of conduct for public officials, or at least not for all of them," they stated.

For now, the judge responsible for carrying out the enforcement of the sentence will maintain his initial decision: to grant a period of five business days (cinco días hábiles) from the notification for the convicted individuals to voluntarily appear at the Retiro Courts.
Cristina Kirchner's defense based its request mainly on the age of the former president, who is currently 72 years old (72 años). While the Code of Criminal Procedure contemplates the possibility of house arrest for individuals over 70 years old, its granting is not automatic, but rather is at the discretion of the Enforcement Judge.
