El Fortín appealed to the AFA Appeals Tribunal after the financial sanction against Xeneize for including six foreigners in the roster and requested a precautionary measure to halt the quarter-finals
The definition of the clash between Boca and Vélezfor the round of 16 of the Copa Argentina has not yet been resolved. After theDisciplinary Tribunaldecided to uphold the match result and sanction Xeneize only with a financial penalty, the club from Liniers decided to continue with its claim and took the case to the Appeals Tribunal of the Argentine Football Association(AFA).
The Vélez management did not limit itself to presenting the appeal of the ruling, but also urgently requested the suspension of the match between Boca and Racing, corresponding to the quarter-finals and scheduled for this Sunday, September 25 at the Gigante de Arroyito. According to the institution, allowing the tournament to proceed while the appeal is being considered could cause "irreparable harm".

In its presentation, Vélez argued that any eventual favorable resolution would be impossible to execute if the competition continues and the tie against the Academy is played. To support the precautionary request, the club referred to various articles of the AFA regulations.
Among them is article 47.1, which contemplates the possibility of adopting provisional measures to ensure the administration of justice and prevent irreversible harm. Articles 58.b and 58.f were also cited, which grant the president of the Appeals Tribunal powers to act in urgent situations, and 59.1 and 59.2, which allow the suspension of the execution of a ruling when there is a duly substantiated formal request.

The conflict began after the match played on September 2, which ended with the elimination of Vélez by penalties. From the Fortín, they reported that Boca had included six foreign players in the roster, one more than the allowed limit, although Ángel Romero remained as a substitute and did not enter the field.

After analyzing the protest, the Disciplinary Tribunal considered the regulatory infringement due to the presence of the six foreigners to be established, but understood that there was no improper alignment because none of the players considered ineligible participated in the match. For that reason, it rejected Vélez's request to be awarded the victory by 3-0, upheld the sporting result, and left Boca qualified for the quarter-finals.
The only sanction for the team from the Ribera was financial: a fine equivalent to 1,000 ticket values, which reportedly represents about 50 million pesos.
