The Government of Javier Milei took a new step in the privatization process ofArgentinian Water and Sanitation Sociedad Anónima (AySA) and approved the model Concession Contract that will govern the relationship between the State and the future operator of the company.
The decision was formalized through Resolution 543/2026, published this Tuesday in the Official Gazette, which establishes the bases for the transfer of the company and the conditions it must meet during the transition to a new ownership.
As provided, AySA will have to implement a transition action plan to sustain adequate operational management while the change of control takes place. This stage seeks to avoid alterations in the provision of essential services such as drinking water and the sewer system

The scheme designed by the Executive aims at the incorporation of a strategic operator, which will be selected through a national and international public tender process. The objective is to advance the sale of at least 51% of the company's stock package
.
The measure is part of the application of Law 27,742, which declared the company “subject to privatization” and empowered the Government to carry out the necessary mechanisms to divest itself of state majority participation.
In accordance with the recitals of the resolution prepared by the Ministry of Economy, the sales process will be structured in order to ensure the participation of actors with technical and financial capacity to operate the service.
At the same time, for the percentage of shares that remain in the hands of the National State, it is expected to be placed in local stock exchanges and markets. This section of the process will have the intervention of the Temporary Special Executing Unit “Agency for the Transformation of Public Enterprises

One of the central axes of the measure is the early approval of the concession contract, which aims to establish with greater precision the rights and obligations of both the State and the future concession holder. This contractual definition follows the recommendations of the Detailed Report prepared by the Agency for the Transformation of Public Companies
.
Based on this decision, the company must comply with the Transition Action Plan for the remaining period of the current year. In addition, the contract contemplates the incorporation of goals and commitments that will be extended over time, especially during the first tariff cycle scheduled between January 2027 and December
2031.
The Ministry of Economy, in its role as enforcement authority, will be responsible for taking the necessary measures to ensure that the privatization process does not cause interruptions in the service or affect its quality or coverage.
In this way, the Government of Milei is making progress in reconfiguring the AySA management scheme, with the objective of realizing privatization under a previously defined regulatory framework.
