From Security, they pointed out that Judge Karina Andrade acted arbitrarily

The Ministry of National Security, under the leadership of Patricia Bullrich, filed a criminal complaint against Judge K Karina Andrade, responsible for releasing detainees without solid grounds following the serious incidents that occurred on March 12 in front of the National Congress.  The government's decision reflects its unwavering commitment to public order, citizen safety, and the unrestricted respect for the rule of law.

The magistrate, in charge of the Criminal, Misdemeanor, and Offenses Court No. 15 of the Autonomous City of Buenos Aires, is accused of the crimes of malfeasance, failure to fulfill public official duties, and aggravated concealment. According to the complaint, Andrade ordered the release of 114 people detained during the retirees' march without reviewing evidence or criminal records, which allegedly facilitated the impunity of individuals with records of serious crimes.

Defense of law and order

The Ministry of Security indicated that the judge acted arbitrarily, interfering in a flagrancy process that exclusively corresponds to the prosecutor. Instead of following legal procedures, Andrade made informal decisions through an instant messaging group like WhatsApp, without leaving official records and without involving the Public Prosecutor's Office. This conduct, according to the accusation, undermines transparency and due judicial process.

Minister Patricia Bullrich stated that "the national government has the responsibility to protect citizens and ensure democratic order. Poorly founded judicial decisions that jeopardize public safety can't be allowed." Additionally, Bullrich reminded that "Argentines deserve to live in peace and without fear", and reaffirmed that the full weight of the law will be applied against those who promote violence or attempt to disrupt social peace.

Recidivism and severity of the events

The file highlights that several of those released had criminal records for offenses such as assault, drug trafficking, possession of weapons, and theft. However, the judge did not review their files before deciding on their release. Additionally, she referred to an alleged lack of capacity in detention centers, an argument that was refuted: spaces in the Federal Penitentiary Service and the Federal Police were available.

The complaint emphasizes that Andrade's actions could have facilitated the concealment of crimes committed during the disturbances, which included attacks against the Police and damage to public spaces. More than a dozen officers were injured in the operation, highlighting the severity of the events.

The defense of institutionalism and democracy

The government of President Javier Milei remains firm in defending the rule of law and will not allow impunity to undermine the foundations of Argentine democracy. For this reason, the Ministry of Security requested that the federal judiciary advance the investigation, as the events could constitute crimes of sedition, attack on constitutional order, and aggravated illicit association.

The national administration insists that "there is no place for the violent or for those who protect criminal actions." In this line, Minister Bullrich emphasized: "Our priority is to restore peace to Argentines and ensure that those who break the law face the consequences of their actions."

The case is now in the hands of Judge María Servini, who must determine the criminal responsibilities of Andrade and proceed with the collection of evidence, including audiovisual material and testimonies from those affected by the disturbances.
