The Federal Justice decided to close the criminal complaint filed by Vice President Victoria Villarruel against the journalist Javier Negre, considering that the facts reported do not constitute any crime, in a severe judicial setback for the head of the Senate after her attempt to prosecute her political differences with the director of La Derecha Diario.

The decision was issued by federal judge Sebastián Casanello, who concluded that the publications and statements questioned by Villarruel have no criminal relevance and do not constitute public intimidation, an attack against democratic order or any other criminal figure.

However, despite the dismissal of the case, the defense of Negre - led by Mariano Cúneo Libarona, lawyer for Javier Negre and also legal representative of other high-profile figures such as Luis Caputo, Santiago Bausili, Lionel Messi and Pollack - appealed the resolution with the objective of obtaining the formal dismissal of the journalist and closing the file permanently.

Justice demolished the complaint promoted by Villarruel

The cause had been initiated after Villarruel criminally denounced Negre for posts on social networks where the journalist described her as a “traitor” and “coup”, in addition to accusing her of conspiring politically against President

Javier Milei.

However, after analyzing the case, both the Federal Attorney's Office No. 9 and Judge Casanello agreed that the statements reported do not have sufficient entity to constitute a crime and are far from framing criminal figures as serious as those invoked by the vice president.

In his ruling, the magistrate held that Negre's sayings did not generate public fear, did not alter social peace and had no capacity to affect the institutional functioning of the country.

Cúneo Libarona argued that Villarruel's complaint “never had a basis.”

In a dialogue with this media, Mariano Cúneo Libarona, assured that the decision of the Justice to close the case fully ratifies the position held by the defense since the beginning of the file. As she explained, both the prosecution and her study agreed that the events reported by the vice-president “do not constitute a crime” and that the conduct attributed to the journalist does not fit into any criminal offence

“The fiscal ruling is absolutely in tune and consistent with the defense's request for dismissal, to the extent that the facts described by the vice president do not constitute a crime. The prosecution, like us, understood that the behaviors attributed to Mr. Negre cannot be penalized because they do not form part of any crime. Therefore, it is clear that the complaint filed by Dr. Villarruel was never substantiated,” said the lawyer, who also recalled that the vice-president retains the constitutional right to appeal any resolution she considers to be offensive, within the framework of the dual instance guarantee provided by Argentine legislation and international treaties in criminal matters

Cúneo Libarona appealed for Negre to be dismissed

Although the judge decided to file the file, he refused to issue the dismissal requested by the defense due to a technical procedural issue: he argued that there was never a formal charge against Negre, so it was not appropriate to issue that ruling at

this stage.

In view of this, the defense appealed the decision in order for the House to review the ruling and move towards a definitive dismissal that would prevent any future reopening of the case.

ruling represents a new political coup for Villarruel, who tried to bring to the judicial level a political and media dispute that the Justice considered completely alien to the criminal sphere

In addition, the court refused to deepen other lines of investigation promoted in the file, such as requests for financial or financial analysis of Negre, noting that these measures were inconductive once the existence of a crime had been ruled out.

In this way, the judicial offensive promoted by the vice president ended up completely dismantled in court, while the journalist's defense now seeks the House to transform the file into a definitive dismissal.
