Córdoba's justice system halted the implementation of the new Pension Equity Law

The 3rd Nomination Contentious Administrative Chamber issued a precautionary measure that partially suspends the effects of the pension reform. This judicial ruling orders the Pension Fund to refrain from applying the recalculation of benefits provided for in the ministerial regulations. The decision arises after the filing of an amparo appeal by a beneficiary who considered that her current economic rights had been violated.

The judiciary interpreted that the regulation of Law 11.087 consolidated a real threat to the income received by provincial retirees. Initially, the request had been rejected by the court, which considered that the alleged grievance still represented a future and uncertain event. However, the official publication of Resolution 496 of the Ministry of Economy changed the legal scenario and prompted a review of the decision.

The court decided to issue a measure of non-innovation until the substantive issue regarding the constitutionality of the challenged articles is defined. Politically, this judicial pronouncement is seen by various sectors as the establishment of a legal limit on the powers of the Executive of Córdoba. The authorities of the Pension Fund must ensure that the new rate is not applied to the benefits of the person who filed the aforementioned lawsuit.

The ruling emphasizes that it is appropriate "to preserve until that occurs the pension rights of the plaintiff, which warrant differential protection." Legislative representatives of the opposition stated that the judicial decision confirms their previous warnings about the nature of the statute. Opposition blocs maintain that the final verdict must determine whether there is an improper confiscation of retirees' income. Expectations are focused on this individual case serving as a trigger for new collective filings during the next period. The discontent with the new contribution caps and scales not only affects unions, but also members of the Judiciary and various provincial public officials. These sectors had traditionally remained on the sidelines of the most severe economic adjustments, but they now find themselves affected by the new legal structure. The current contribution scale is generating strong internal resistance that could lead to administrative paralysis through challenges.

The unions that contribute to the Pension Fund defined a "plan of struggle" for the summer months that includes protests and technical meetings. The legal advisers of the union organizations are currently coordinating a common strategy to file collective amparos before the courts. "We are not going to leave any avenue unexplored," union spokespeople stated when confirming the holding of new meetings during the January recess.

The immediate objective of the union leadership is to use the precedent of this precautionary measure to demonstrate the existence of real economic harm. Meanwhile, the Executive Branch keeps its defense of the Pension Equity Law and has not made any official statements about this new setback.
