The highest court, with two conservative justices joining the extreme left wing of the Court, ruled in a decision that children born in the United States to undocumented immigrants and holders of temporary visas are protected by the Fourteenth Amendment.
Bank's bill uses a legislative maneuver inspired by the foundations of Judge Brett Kavanaugh. In that ruling, the magistrate expresses that Trump's decree conflicts with the current statute, but that Congress has the authority to reform the law and create clear exceptions, which is exactly what this Trump-supporting senator's legislative proposal does.

Both Trump and those supporting the measure argue that the phrase in the Fourteenth Amendment "subject to their jurisdiction" was never intended to grant automatic citizenship to the children of those who entered the country illegally or who travel solely to obtain U.S. citizenship for their newborns.
If this new bill is approved, the Immigration and Nationality Act would be amended to establish that anyone entering the United States without authorization or for the purpose of birth tourism would be considered an "invader". Therefore, their children born in the U.S. would not receive automatic citizenship. This would be achieved without amending the Constitution and does not contradict the court's ruling.
There is a widespread sentiment within the Republican Party that its members will not give up after the Supreme Court ruling and will continue seeking alternatives to limit this fraud against national laws.
