A little more than a month after the aberrant crime of Ángel Nicolás López in Comodoro Rivadavia, the case has taken a decisive turn against the chain of state negligence. On May 8, 2026, the victim's father, Luis López, under the sponsorship of Dr. Roberto Castillo, filed a criminal complaint against Jennifer Grisel Leiva, a member of the Rights Protection Service, for the alleged crimes of non-performance of the duties of a public official and abandonment of a person followed by death
.The seriousness of the case is exposed in the autopsy, which revealed that the 4-year-old boy died as a result of 22 internal blows.
According to the complaint, Leiva was responsible for preparing the technical reports that were “central” for Judge Pablo José Pérez to decide to take the possession of the father and hand over the child to his biological mother, Mariela Altamirano, and his partner, Maicol González, who are now serving preventive detention for the murder.
The complaint argues that the psychologist's intervention lacked the “minimum rigor required”, limiting herself to carrying out “desk interviews” without a “real assessment of the family environment or of the internal family dynamic” in which the child was going to remain.
