The ruling reignited criticism of Kirchnerist management; the young woman with cancer who died without being able to say goodbye to her father

The case that moved the country during the unconstitutional quarantine kirchnerista once again took center stage in the judicial scene. The Río Cuarto court acquitted José Fernando Andrada, former director of the Huinca Renancó hospital, and Analía Morales, social worker at the Río Cuarto hospital and member of the Regional COE, who were charged with abuse of authority and failure to fulfill the duties of a public official after preventing Pablo Musse from entering Córdoba to say goodbye to his daughter Solange, who was hospitalized in a terminal state due to breast cancer.

The ruling was categorical: Andrada was acquitted by a majority of the popular jury and Morales unanimously. The decision, which marks the end of a judicial process filled with hearings involving former officials, doctors, police officers, and health authorities, left tears and a sense of helplessness on the face of Solange's father, who left the court visibly broken.

On August 16, 2020, in the midst of the pandemic and under the weight of the restrictions imposed by the violent woman-beater, Alberto Fernández, and endorsed by the provincial authorities of Córdoba, Pablo Musse tried to enter the province through the Huinca Renancó health checkpoint. He was accompanied by his sister-in-law, Paola Oviedo, who lives in Alta Gracia and has a motor disability. Both had national circulation permits for "force majeure" and a "return home" permit for Oviedo.

However, they lacked a negative PCR result valid for 48 hours, which Córdoba required for entry. Although two rapid tests were performed on them, which were later classified as false positives, they were ordered to return immediately to Plottier, Neuquén, under a controversial "encapsulation" escorted by patrol cars.

Prosecutor Julio Rivero maintained that both Andrada and Morales were directly responsible for the decision. He recalled that protocol 48 provided for exceptions in cases of force majeure and that Pablo Musse should have been transferred to the Río Cuarto Hospital to have the PCR performed there.

"Not only were basic human rights violated, but also those of a person with a disability," he warned, referring to Oviedo. In his closing argument, he requested one year and six months in prison for the accused, that Solange and her family be recognized as victims of institutional violence, and the placement of a commemorative plaque at the southern border of Córdoba.

 

"Be careful with looking for responsibility higher up," Rivero said, hinting at the political pressures of a structure that always avoided looking at the Casa Rosada and the provincial government.

The defense of the accused argued that neither Andrada nor Morales had direct responsibility, pointing out that the operation replied to a higher hierarchical chain. Throughout the trial, former ministers, doctors, and COE members testified, who justified the strict application of protocols in a context of high viral circulation and no vaccines, although some admitted that a humanitarian exception could have been considered.

The plaintiff's attorney, Carlos Nayi, tried to broaden the accusations, demanding that Andrada be tried as a co-author of abuse of authority and Morales for aggravated unlawful deprivation of liberty. However, his requests did not succeed.

Before the last hearing, Pablo Musse had already expressed his distrust in the justice system: "I don't believe there is justice." After the verdict, he was harsher: "Here, everyone from Alberto Fernández down should be in the dock, giving explanations." He also criticized the lack of application of the exception protocol in terminal cases: "An incorrect decision they made, plus everything Paola suffered on the return trip due to her disability."

Meanwhile, Solange's mother described the experience as a painful setback: "It's like going back again. Wounds that keep bleeding. Although justice brings relief, it doesn't close a wound."
