A Democratic judge released a gang member convicted of murder whom the Trump administration had arrested and was preparing to deport

A terrorist belonging to the Salvadoran gang MS-13, convicted in his home country for executing a civilian at point-blank range, was inexplicably released in the United States by order of a judge appointed by former Democratic President Joe Biden.

Federal Judge Jinsook Ohta ordered the release of David Antonio Aviles Pérez, 35, also known as "La Bruja," after arguing that immigration authorities had kept him detained for five months without granting him a bail hearing or assessing whether he posed a danger to society or a flight risk. Logically, the decision sparked outrage from the Trump administration.

"This radical activist judge has put American lives at risk by releasing a wanted murderer," stated Markwayne Mullin in a statement released on Saturday. "This is the second time this dangerous undocumented individual has returned to the streets in California," he added. "Because sanctuary politicians want to play politics from the bench, innocent citizens are left unprotected."

Aviles Pérez committed a brutal murder in 2014 in El Salvador and is identified by prosecutors in that country as an active member of the Mara Salvatrucha. He was convicted in absentia in December 2025 and sentenced to 20 years in prison for aggravated homicide. During the crime, the now-released individual shot the victim in the chest, back, and face before fleeing.

According to the Department of Homeland Security (DHS), Aviles Pérez entered the United States on an undetermined date and location, and three years ago was arrested in California after threatening a homeless person with a machete in a park. Although he was prosecuted and convicted for that incident, he was later released.

ICE agents detained him again on March 26 in San Diego, keeping him in custody pending his deportation to El Salvador. He remained incarcerated until Ohta ordered his release on the grounds that federal agents "violated his rights."

Not satisfied with ordering the release of the murderer, Judge Ohta prohibited ICE from detaining him again unless an immigration judge first holds a bail hearing and approves a new deprivation of liberty. Given this scenario, federal authorities had no choice but to proceed with the release.

Mullin asserted that the ruling will not stop the government's policies against foreign criminals: "DHS and ICE will not be intimidated by these partisan games. If California leaders do not protect Americans, DHS will."
