The republican administration announced the suspension of funding for the state's Medicaid Fraud Control Unit after identifying multiple irregularities

The administration of President Donald Trump suspended federal funding for the New York State Medicaid Fraud Control Unit (MFCU) after concluding that the agency had recorded years of insufficient performance in the criminal prosecution of fraud against the healthcare program. The decision intensified the confrontation with the state's Attorney General, Letitia James, who rejected the accusations and described the measure as a politically motivated attack.

The suspension, which took effect on July 1, will remain in effect until September 30 while state authorities attempt to meet a series of requirements imposed by the Department of Health and Human Services (HHS). If New York fails to correct the identified deficiencies, the federal government warned that the state could permanently lose the grant allocated to the unit for fiscal year 2027.

The decision comes at a politically sensitive time for James, who is seeking re-election as New York Attorney General and faces numerous new criticisms from Republican leaders, who argue that her administration has deliberately weakened the criminal prosecution of Medicaid fraud.

Republican Saritha Komatireddy stated that the suspension confirms the allegations she has made during the election campaign regarding the unit's operations. According to the candidate, James chose to reduce the opening of criminal investigations and allowed numerous cases to remain open for years without resolution.

Komatireddy argued that this strategy harmed both taxpayers and beneficiaries of the healthcare system, allowing individuals involved in fraud to continue operating while patients and seniors were exposed to abuse and neglect without those responsible being brought to justice.

The criticisms were supported by the Republican Attorneys General Association (RAGA). Its executive director, Adam Piper, asserted that while Republican attorneys general are intensifying the fight against fraud, waste, and abuse of public resources, some Democratic attorneys, including Letitia James and Minnesota Attorney General Keith Ellison, have failed in combating these types of crimes. Piper added that Republican attorneys will continue to collaborate with the Trump administration and the White House task force to strengthen the prosecution of fraud and protect taxpayer money.

The criticisms are backed by a letter sent on June 30 by the HHS Office of Inspector General (OIG), which rejected the annual recertification of the New York Medicaid Fraud Control Unit after evaluating its performance.

According to the report, the unit became the worst performing among large states in terms of criminal prosecution of Medicaid fraud, despite receiving around $60 million annually in federal funding and having over 270 employees.

Inspectors noted that between 2023 and 2025 the unit secured only 53 criminal convictions for fraud, the lowest record among comparable agencies. The second worst performing state obtained 129 convictions during the same period.

Furthermore, the report indicates that New York ranked last in the number of criminal charges, having filed fewer than ten fraud indictments in four of the last five years.

The audit also detected significant delays in investigations. 34% of open cases had been unresolved for more than three years, and 69% of referrals made by the Medicaid Program Integrity Unit remained pending for at least two years, causing significant backlogs in case processing.

Federal officials attributed these results to a ''deliberate leadership decision'' to prioritize high-impact civil lawsuits over criminal investigations. While they acknowledged that the office maintained competitive performance in recovering funds through civil actions, they concluded that this strategy severely weakened its ability to pursue criminal fraud.

In light of these findings, James rejected the accusations and claimed that the federal government's decision is politically motivated rather than technical.

In a statement, the Democratic attorney incorrectly asserted that during her tenure her office recovered more than $627 million for the Medicaid program and recalled that HHS had previously recognized New York as one of the states with the best results in resource recovery through civil actions.

Her office also highlighted that HHS identified New York as one of the four states responsible for approximately half of all civil recoveries recorded in the country during fiscal year 2025. Additionally, James mentioned that several lawsuits related to multimillion-dollar Medicaid frauds were recently announced.

The attorney warned that the suspension of funding only benefits those who commit these crimes and confirmed that she is exploring all available legal avenues to challenge the Trump administration's decision.

However, James's position was questioned by federal authorities tasked with investigating these types of crimes. The first assistant U.S. attorney for the Northern District of New York, John A. Sarcone III, stated that the unit's poor performance cannot be attributed to a political dispute.

Sarcone, who leads the revitalization of the Healthcare Fraud Task Force in that district, noted that between 2021 and 2025 the state unit averaged only nine criminal charges per year, compared to over one hundred annually during the three years prior to James taking office.

According to the official, Medicaid fraud has never ceased to exist, but the state's criminal response significantly decreased under the current attorney general's administration. The confrontation between the federal government and James adds a new episode to the prolonged dispute between the Trump administration and one of its main judicial opponents, with consequences that could extend to both the political arena and the functioning of the fraud control system in New York.
