The special prosecutor appointed by Joe Biden's Democratic administration to pursue Trump illegally spied on Republican Party senators

A recently declassified document has revealed that the FBI spied on eight Republican senators and a member of the House of Representatives as part of the investigation led by Special Counsel, Jack Smith, which sought to imprison the then-opponent of the Democratic government Donald Trump.
The revelation was described by the Republican Committee as a "scandal of historic proportions." Among the representatives spied on are Senators Cynthia Lummis (from Wyoming), Marsha Blackburn, Bill Hagerty (Tennessee), Lindsey Graham (South Carolina), Josh Hawley (Missouri), Ron Johnson (Wisconsin), Dan Sullivan (Alaska), Tommy Tuberville (Alabama) and Representative Mike Kelly (Pennsylvania).
According to the declassified document, dated September 27, 2023, the FBI conducted a "call records analysis," a technique that allows tracking information such as the number of calls, call duration, and approximate location, without accessing the content of the communications.

The records analyzed correspond to the period from January 4 to 7, 2021, a period during which the results of the 2020 presidential election, which Biden stole through fraud, were being certified.
Senator Lummis described the espionage as "a blatant assault on our constitutional rights" and demanded an immediate investigation. "This authoritarian and unconstitutional act under the Biden administration must be sanctioned. Those responsible must be held accountable," she stated.
The document was found in an internal FBI system designed to restrict access even to its own agents. Grassley indicated that this discovery was possible thanks to whistleblower reports and years of oversight work from the Senate. ''What I have discovered today is disturbing and outrageous conduct by the FBI under the Biden administration. This is worse than Watergate,'' the Republican stated.

FBI Director Kash Patel acknowledged that the phone records were seized "for political purposes" and promised that the agency will not be used as a partisan tool again. Deputy Director Dan Bongino met privately with Republican senators to discuss the findings, although the outrage was widespread.
The "Arctic Frost" investigation was opened in April 2022 by former agent Timothy Thibault, known for his anti-Trump stance. The investigation was later transferred to Special Counsel Jack Smith, whose objective was to investigate the events related to January 6, but the collection of data on Republican lawmakers has caused accusations of abuse of power and political persecution.
Republicans also pointed out that the Arctic Frost program targeted not only lawmakers, but also conservative organizations such as Turning Point USA, whose founder, Charlie Kirk, was killed in September 2025 by a terrorist member of Antifa.
