The president of the United States, Donald Trump, signed a decree on Monday that criminalizes the burning of the American flag, a hate crime that constitutes a "deeply offensive declaration of contempt and hostility toward the nation."
Trump emphasized during the signing that "if you set a flag on fire, you get a year in prison, with no early release or anything. And it stays on your record... You'll see how this ends immediately," highlighting the firm and exceptionless nature of the measure.
"For nearly two and a half centuries, thousands of American patriots have fought, bled, and died to keep the Stars and Stripes flying proudly. The American flag is a special symbol in our national life that must unite and represent all Americans from all backgrounds and walks of life," the decree signed by Trump reads.

In the official text, the White House states that the American flag represents "the freedom, identity, and strength of our country" and that desecrating it "is exceptionally offensive and provocative." It also explains that burning the flag incites violence and riots, and that certain foreign groups have used it as a calculated act to intimidate and threaten Americans because of their nationality.
The decree also refers to the historic rulings of the United States Supreme Court on the First Amendment, acknowledging that, although freedom of expression protects much political speech, "the desecration of the American flag carried out in a manner that may incite imminent illegal action or that constitutes fighting words is not constitutionally protected."
