The conflict surrounding the Instituto Obra Médico Asistencial (IOMA) has reached the Federal Court with a criminal complaint filed by Marcelo Mazzeo, attorney, citizen, and councilman of La Libertad Avanza from the Esteban Echeverría Party.
The complaint targets the director of the organization, Dr. Homero Giles, and the governor of the Province of Buenos Aires, Axel Kicillof, in his capacity as the highest-ranking authority, for alleged irregularities in the management of the organization.
The complaint, filed before Federal Court No. 1 of La Plata, states that the officials may have committed serious crimes against public administration, including aggravated fraudulent administration, embezzlement of public funds, abuse of authority, breach of duties of a public official, negotiations incompatible with public office, and illicit association.

Mazzeo keeps that IOMA, with a budget exceeding 188 billion pesos (414,469,000 USD) annually, was "politically captured" and turned into a "political fund or propaganda instrument," diverting resources that should be allocated to healthcare. According to the complainant, this situation has caused a structural collapse in the benefits system, directly affecting members and health professionals.
Among the central points of the complaint, the healthcare collapse and underfunding of IOMA stand out. The complaint asserts that there are systematic violations of the right to health, including delays in payments to medical entities such as FEMEBA, FENECON, and FREMEBO, delays in professional fees, and the suspension of vital treatments, including oncology, prosthetics, and chronic medication.
Another aspect highlighted is the compulsory enrollment of municipal and provincial employees, which the complaint describes as a "regime of institutional extortion" that violates citizens' right to freely choose their health coverage.

The complaint also accuses the creation of the Civil Association of Ambulatory and Private Polyclinic Establishments (ACEAPP) as a mechanism of illegal private intermediation. This entity, led by Silvina Fontana, who also heads RM Salud S.R.L., is said to have caused conflicts of interest and diversion of public funds.
Furthermore, director Homero Giles is charged with failure to render accounts, for refusing to appear before the Buenos Aires Legislature to be questioned, despite formal requests from deputies and a senator. Meanwhile, Governor Kicillof is singled out for his "repeated failure to supervise, investigate, or correct the irregularities" within the organization, which, according to the complainant, constitutes criminal liability for functional omission.
Mazzeo requested that the court immediately open the criminal investigation, adopt precautionary measures regarding IOMA's funds, and conduct searches and seizures of documentation at the headquarters of IOMA, the Ministry of Health, ACEAPP, and RM Salud S.R.L. He also requested to be recognized as a plaintiff in the case.
With this complaint, a judicial chapter opens regarding the management of IOMA and the oversight of public health in the Province of Buenos Aires, while concern grows among citizens and health professionals about transparency and the mismanagement of resources under Axel Kicillof's administration.
