
Trial for Maradona's death in crisis: scandal and possible nullity
A production company linked to a judge allegedly filmed inside the court, and the chaos in the courtroom jeopardized the process
The trial for the death of Diego Armando Maradona added a scandalous chapter that could jeopardize the entire case. Two people entered the courtroom with cameras to film without authorization, raising suspicions among those present.
According to journalist Martín Candalaft on the program DDM (América), the production company responsible for that recording is allegedly directly linked to a brother of Judge Julieta Makintach, a member of the tribunal. The situation caused significant discomfort among the parties and raised doubts about the impartiality of the process.
This incident, considered extremely serious by consulted jurists, could lead to a motion to nullify the trial if the direct relationship between the magistrate and the content company that filmed inside the judicial chamber is proven.
Unexpected changes in the tribunal and a failed recusal
This Thursday's session was also marked by unexpected chaos within the tribunal. The judges surprised everyone by entering and changing their usual seats without prior notice. Judge Maximiliano Savarino, who had been presiding over the trial, ceded his role to Judge Julieta Makintach, while Verónica Di Tomasso maintained her position.
Makintach explained that the rotation had been previously agreed upon for internal administrative reasons of the Oral Tribunal No. 3 of San Isidro. However, the surprise caused a strong clash between prosecutors, defenders, and plaintiffs, who argued that the trial should continue under the initial conditions.
As a result of the change in roles, a recusal request was filed against Judge Makintach, which was ultimately rejected. Judge Di Tomasso justified the move by recalling that for the past five years, the tribunal's presidency rotates every May 14 due to the absence of one of its members who retired.
The testimony of psychologist Carlos Díaz was postponed
Amid the commotion, one of the most anticipated testimonies of the process was suspended. Carlos Díaz, the psychologist charged in the case, was scheduled to speak during this session, but the disorder forced the rescheduling of his testimony.
His lawyer, Diego Olmedo, reported that his client was going to make an extensive statement of almost three hours. However, due to the accumulated delay and the scheduled departure of one of the judges at 5:00 PM, they opted to postpone the testimony.
"I'll be back on Tuesday," Díaz told the press, visibly willing to speak when conditions allow. His testimony is considered key in the investigation into the alleged medical malpractice surrounding the death of the soccer star.
A trial on the brink of collapse?
Lawyer Fernando Burlando, who represents Maradona's daughters, warned that the situation could escalate. "If the recusal were granted, this would be a judicial scandal of proportions," he stated.
The tension from the role changes is compounded by the complaint about the presence of a production company linked to a direct relative of a judge. The combination of these factors puts the continuity of the trial at risk, which was already under public scrutiny.
Now, all eyes are on how this episode will impact the legitimacy of the process. If any serious irregularity is proven, the trial could be declared null, a hypothesis that seemed unthinkable just a few days ago.
