The government of United States rejected the habeas corpus petition of José Serrano, former Minister of the Interior of Ecuador. His goal was to be released or transferred to special detention as an asylum seeker. ICE submitted eight documents supporting its opposition.
Serrano has been detained since August 7. His tourist visa expired and his asylum application has not yet been solved. Without immigration status, he has no right to be free.
On September 16, the bond hearing was reinstated at Miami Krome before Judge Romy Lerner. Serrano requested a set amount to be released while his asylum is decided, but so far there is no resolution.
September 30 will be the key hearing: if his asylum is granted, Serrano will remain in the U.S. with periodic appearances at the consulate. If it is denied, he will be immediately deported to Ecuador.
