The case regarding the murder of Fernando Báez Sosa once again took center stage in the judicial arena after it became known that the defense of Lucas Pertossi filed a request for a review of the conviction.
The development was addressed in the newscast Telenoche, where they detailed that the motion revolves around the alleged nullity of the process, based on the argument that there was a joint defense that would not have adequately represented the individual interests of each defendant.
According to what they explained in the program, the motion must be analyzed by the Buenos Aires Court of Cassation. It is not an immediate decision and it doesn't imply, for now, concrete changes in Pertossi's procedural situation.
Journalist Rodrigo Alegre pointed out that the ruling must still go through key stages to reach what is called "double conformity", that is, the confirmation of the sentence by a higher court.
Fernando Burlando's response
Amid the impact of the issue, the lawyer for the Báez Sosa family, Fernando Burlando, clarified what the real scope of the appeal that was filed is.
"All these young defendants obviously tried several avenues of appeal. The extraordinary appeals were really denied," he explained.
Burlando explained in detail that, after the confirmatory ruling by Cassation, several of those convicted filed appeals before the Supreme Court and also federal extraordinary appeals, which were rejected.
Lucas Pertossi
In that regard, he specified that what Pertossi filed is a complaint against the rejection of that federal extraordinary appeal. "Yesterday there was a complaint regarding Lucas Pertossi's denied federal extraordinary appeal, and there was misinformation stating that he had filed an appeal for nullity before the Court," he pointed out.
The lawyer indicated that this is a usual procedural step within the appeal stages and that the appeals were grouped in the same office of the Supreme Court.
Can the situation of those convicted change?
Burlando was categorical regarding the judicial future of the defendants: "There are only a few meters left to reach the end."
He also ruled out the possibility of a release in the short or medium term. "I don't think they'll be released in ten or even fifteen years. So far, things have been proceeding in accordance with the law," he stated.
