The Civil Chamber overturned the ruling that endorsed the vacancy at the club and ordered the official to resume his position as head of the institution
San Lorenzo has a president again: Marcelo Moretti must officially resume his role following the decision of the Civil Chamber, which upheld the injunction filed by the leader himself. The court considered that the alleged vacancy of the club was "irregular"and that the process should be rolled back until the Board of Directors meets again legitimately and in accordance with the Bylaws.
The judicial decision overturns the first instance ruling and orders that the Board of Directors be convened again, this time in a regular manner and under Moretti's leadership. In addition, the effects of the meeting of the Executive Committee of the Assembly of Representatives and the call for the Extraordinary Assembly that was scheduled have been suspended.
La resolución de la Justicia
In his filing, Moretti argued that there was no real vacancy since there were still alternates available on all lists to fill the vacant positions. He also reported a context of pressure and harassment during the September 16 meeting, where resignations were allegedly submitted "under coercion".
The Chamber found that there was "plausibility of rights" in his claim and a "danger in delay" if what it described as a vacancy "fictitious" were to proceed. For this reason, it ordered a new Board of Directors meeting to be called within a maximum period of 15 days, with supervision by the General Inspectorate of Justice (IGJ) if irregularities are detected.
As part of the measure, the court raised the required bond from 10 to 40 million pesos (22,046 to 88,184 pounds), an amount that Moretti must cover to keep the injunction in force.
This way, while the core of the conflict is being solved, Marcelo Moretti regains his position as president of San Lorenzo and is once again at the helm of a club facing a delicate institutional situation.
